Fines for Failing to Comply

Beginning on July 1st, 2021, once a new or renewed tenancy is signed on a Bridge Pā rental property, all Healthy Homes compliance items need to be taken care of inside of 90 days.

The person who is liable for this fine is the one who is listed on the tenancy agreement as being the person letting the property out, so it could be the name of the landlord or the company that manages the property.

The information contained in the Statement of Compliance needs to be up-to-date at the time that the tenancy agreement is executed, and it should be maintained throughout the duration of the tenancy when any associated work has been completed.

It’s important to note that a landlord who manage several rental properties can face more severe penalties for not complying. The most severe penalties are given only for serious breaches, and landlords with at least six rental properties could be fined as high as $50,000, and as much as $100,000 in hearing claims.

Tenancies signed from 1 July 2019 to 30 , June 20,21

  • The insulation of the ceiling and underfloor is mandatory to all Bridge Pā and New Zealand rental homes where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewed, new or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with the Healthy Homes Standards that apply or will be applied to the rental property.

Starting 1 July 2021

  • Private landlords and property managers have to ensure that their rental properties are in compliance to the Healthy Homes Standard within 90 days of a new, renewed , or altered Tenancy.
  • All boarding houses (except Kainga Ora and Community Housing Providers with registered boarder household tenancies) must meet the Healthy Homes Standards regardless of when the tenancy began.

From 1 July 2023

  • All houses which are rented through Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered must be in compliance with the Healthy Homes Standards regardless of the date the tenancy was started.

Starting 1 July 2024

  • All rental homes must be in compliance with the Healthy Homes Standard regardless of the time of the first day of tenancy.
Unreasonable Gaps & Holes

Heating Bridge Pā

Rental properties in Bridge Pā should have a permanent source of heating which can warm the largest or main living space to at least 18degC, even during the coldest winter days. For most homes, larger fixed heating equipment like heat pumps, wood burners, pellet burners or flued gas heaters will be required. In some instances, like small apartment buildings the smaller fixed electric heater may suffice.

If your main living space already has a permanent heating source such as a heat pump, then it might need a top up to be able to meet the standards. Certain kinds of heaters aren’t able to be utilised to meet the standard because they’re inefficient, unaffordable to operate and/or unsafe to run.
