Fines for Failing to Comply
Since the 1st July of 2021, when a new or renewed tenancy is signed on an Ahuriri rental property, all Healthy Homes compliance items have to be finished by the end of 90 days.
Beginning on July 1st, 2021, when a new or renewed lease is entered into on the Ahuriri rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Inability to adhere to all of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. Additionally, if a currently-in place Healthy Homes Statement of Compliance isn’t incorporated within a new, renewed or revised tenancy agreement, it could result in an additional fine or infringement fee.
Every tenant is entitled to request details about the Healthy Homes Standard and how they are related to the house they are living in. If the property manager fails to supply the required information within 21 days from being informed of the request, they will receive an infringement letter and be fined upto $750.
In addition, there’s an additional fine of up to $900 for landlords and property managers that provide false or misleading Healthy Homes Compliance Statement or information. The person who is liable for this fine is the one who is identified on the tenancy agreement as the one who is leasing the property out which could be the name of the landlord as well as the property management company.
All information in the Statement of Compliance needs to be accurate when the tenancy contract is executed, and it should be maintained during the entire tenancy, as relevant work gets completed.
It is important to note that landlords who own multiple rental properties may receive more severe penalties for not complying. The highest penalties are given for the most serious violations, and landlords who own more than six properties could receive fines of up to $50,000, and as much as $100,000 in the case of hearing claims.
