Fines for Failing to Comply

Since the 1st July of 2021, once a new or renewed tenancy is signed on an Ahuriri rental property, all Healthy Homes compliance work have to be taken care of by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied lease is entered into on an Ahuriri rental property, all Healthy Homes compliance work must be done inside of 90 days.

Inability to adhere to all of the Healthy Homes Standards inside of the anticipated timeframe could result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance is not incorporated in the new, renewed or revised tenancy contract, it could result in an additional fine or violation fee.

It’s crucial to keep in mind that landlords with multiple rental properties may face greater penalties for non-compliance. The highest penalties are given for the most serious violations, and landlords who own more than six properties could be fined as high as $50,000, and even as high as $100,000 in hearings.

Ahuriri Healthy Homes Compliance Timeframes

Tenancies established from 1 July 2019 to 30 June 2021

  • Insulation of the underfloor and ceiling is compulsory for all Ahuriri and New Zealand rental homes where it’s reasonably practicable to install.
  • A Healthy Homes Statement of Intent to Comply along with an Insulation Declaration and an Insurance Statement must be included in any new, renewed or altered tenancy contract.
  • Landlords and property managers must keep records that prove compliance with all Healthy Homes Standards that apply or will be applicable throughout the tenancy period of your rental home.

From 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply with the Healthy Homes Standards within 90 days of a new, renewed or varied lease.
  • All the boarding households (except Kainga Ora and Community Housing Providers with registered Boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All households rented to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rental houses must comply with the Healthy Homes Standards regardless of the time of the first day of tenancy.

Ahuriri rental properties need to have a stable heating source which can warm the largest or main living space to a minimum of 18degC, even during the coldest days of the year. This is the recommended minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental outlook.

The heating source requirements that it be permanently fixed (i.e. not portable), at least 1.5 horsepower in capacity and have the minimum capacity for heating required in the living area. If the heating that you provide is an electric heater or heat source, then it must have an thermostat. This will make the heating more reliable and effective. For most properties, larger fixed heating devices such as heat pumps, wood burners, pellet burners or flued gas heaters are required. However, in some cases like apartments with small spaces the smaller fixed electric heater may suffice.

If the living area is already equipped with a fixed heating source like heat pumps, it might just need an update to ensure it meets the requirements. Certain kinds of heaters cannot be utilised to meet the standard as they are either inefficient, unaffordable to operate and/or unsafe to run.
