Fines for Failing to Comply
As of 1st July 2021, if a new or renewed tenancy is signed on a Havelock North Central rental property, all Healthy Homes compliance work need to be taken care of inside of 90 days.
From the 1st of July in 2021, once a new, renewed or varied tenancy is signed on the Havelock North Central rental property, all Healthy Homes compliance work must be completed inside of 90 days.
Inability to adhere to each of Healthy Homes Standards by the end of the deadlines can result in penalties of up to $7200. Additionally, if a current Healthy Homes Statement of Compliance is not included within an updated, renewed, or revised tenancy agreement it could result in an additional penalty or infringement fee.
Anyone can request information about the Healthy Homes Standard and how they are related to the house they reside in. If the landlord or property manager is unable to provide the necessary information within 21 days from receiving the request, they may be issued an infringement notice and be fined upto $750.
In addition, there is an additional fine of approximately $900 for landlords and property managers who offer a false or inaccurate Healthy Homes Compliance Statement or information. The person who is liable for this fine is the person who is identified on the tenancy agreement as the one who is who is letting the property, so it could be the landlord’s name or the property management company.
All the information on the Statement of Compliance requirements to be accurate at the time that the tenancy agreement is completed, and must be updated during the entire tenancy, as associated work has been completed.
It’s also crucial to note that a landlord who have multiple rental properties may receive even higher fines for non-compliance. The highest penalties are reserved only for serious violations, and landlords who own six or more properties can be penalised up to $50,000, and as much as $100,000 in hearing claims.
