Fines for Failing to Comply

As of 1st July 2021, if a new, renewed or varied tenancy is signed on a Jervoistown rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Tenancies signed between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is required to all Jervoistown and New Zealand rental homes where it is reasonably practicable to put in.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any new, renewed or amended tenancy agreement.
  • Property managers and landlords are required to keep records of their the compliance with each Healthy Homes Standard that apply or will apply throughout the tenancy period of an apartment rental.

Starting 1 July 2021

  • Private landlords and property managers should make sure their rental properties conform in accordance with Healthy Homes Standard within 90 days of a new, renewed or varied tenant.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered for boarding home tenancies) must comply with the Healthy Homes Standards regardless of the time the tenancy began.

From July 1st 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

From 1 July 2024

  • All rental homes must comply with the Healthy Homes Standards regardless of the date when the tenancy started.
