Fines for Failing to Comply

Since the 1st July of 2021, when a new, renewed or varied contract is signed on a Mahora rental property, all Healthy Homes compliance items must be finished inside of 90 days.

Beginning on July 1st, 2021, if a new or renewed lease is entered into on a Mahora rental property, all Healthy Homes compliance work must be done by the end of 90 days.

Failure to meet all of the Healthy Homes Standards by the end of the expected timeframe can result in a fine of up to $7200. Additionally, if the most currently-in place Healthy Homes Statement of Compliance isn’t incorporated in the renewal, new or revised tenancy agreement, it could result in an additional penalty or infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the home they live in. If the landlord or the property manager doesn’t supply the required information within 21 days of being informed of the request, they will receive an infringement notification and could be fined up to $750.

In addition, there is also a penalty of approximately $900 for landlords or property managers who have provided a false or false Healthy Homes Statement of Compliance or information. The person who is responsible to pay this fine is the one who is named on the lease contract as the person who is letting the property, so it could be the name of the landlord as well as the property management company.

All information in the Statement of Compliance needs to be accurate when the tenancy agreement is executed, and it should be kept updated throughout the duration of the tenancy when any necessary work related to it is finished.

It is important to keep in mind that a landlord who manage multiple rental properties may receive even higher fines for non-compliance. Mahora Healthy Homes Compliance Timeframes

Tenancies commenced beginning on 1 July 2019 to the 30th June in 2021

  • The insulation of the ceiling and underfloor is a requirement throughout Mahora and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent as well as an Insulation Statement, and an Insurance Statement should be included in any renewed, new or altered tenancy contract.
  • Property managers and landlords have to keep records that prove the conformance to all Healthy Homes Standards that apply or will apply during the tenancy of an apartment rental.

Beginning 1 July 2021

  • Property managers and private landlords are required to ensure their rental properties comply according to Healthy Homes Standards within 90 days of a new, renewed , or altered tenancy.

If a draught is perceived as a result of gaps or holes the area needs to be sealed.

What are unreasonable gaps and holes?

If you are able to feel external air coming in or the sound of a clear draught emanating from a gap or hole, then it is likely to be a gap or hole which needs sealing in any way. Cracks and gaps that are large should be sealed permanently. Cracks that are greater than 3mm and allow air to enter or exit within the home need sealing. For instance, if an open fireplace isn’t being used, it can create draughts. This should be shut off. Property managers and landlords are accountable for making sure such draughts are eliminated as far as possible.

You don’t need to block up intentional gaps or holes that are part of the building. For example, tiny gaps around doors and windows may be required to allow for movement within the building when the house is heated and cools so that they can still be opened and closed rather than being stuck. Heating Mahora

Mahora rental properties must have a fixed heating source which can warm the principal or the biggest living area to at minimum 18degC, even on the coldest winter days. This is the minimum temperature indoors recommended by the World Health Organisation for people’s physical well-being as well as their mental health.

The source of heat needs to be fixed (i.e. not portable), at minimum 1.5 kW in heating capacity, and must meet the minimum required heating capacity for the main living space. For the majority of houses, bigger fixed heating equipment like wood burners, heat pumps pellet burners, flued gas heaters will be required. In some instances, like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If your living space already has a central heating source, like a heat pump, then it could require an upgrade to meet the standards. Certain kinds of heaters aren’t able to be used to comply with the quality because they’re not efficient, cost prohibitive to operate or unsafe to operate.

Ventilation Mahora

Each living space within a rental home must include at least one open window or exterior door to provide natural airflow. In addition, high moisture areas such as kitchens or bathrooms should be equipped with an externally vented extractor to take moisture away.

Insulation Mahora

Underfloor and ceiling insulation is a requirement to all rental homes from 1 July 2019. All landlords and property managers are required to make sure the insulation meets this new quality. In certain situations, the current ceiling insulation, or the insulation of the subfloor space might need to be topped up or replaced.
