Did you know that the Healthy Homes Standards came into effect on the 1st of July 2021? Landlords must ensure that their Mayfair rental properties meet the minimum Healthy Homes Standards within 90 days of the start of any new or renewed tenancy, and all private rental properties are required to be fully compliant by 1 July 2024.

Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied tenancy is signed for a Mayfair rental property, all Healthy Homes compliance items have to be completed by the end of 90 days.

From the 1st of July in 2021, when a new, renewed or varied lease is entered into on a Mayfair rental property, all Healthy Homes compliance work must be completed inside of 90 days.

Failure to meet all of the Healthy Homes Standards within the anticipated timeframe could result in penalties of up to $7200. Additionally, if a existing Healthy Homes Statement of Compliance isn’t included within a new, renewed or amended tenancy agreement there may be additional penalties or an infringement fee.

It is important to note that landlords who have multiple rental properties may receive more severe penalties for not complying. The highest penalties are handed down for severe violations. Those who have more than six properties could be fined as high as $50,000, and as much as $100,000 in hearings.

Mayfair Healthy Homes Compliance Timeframes

Tenancies that were signed from 1 July 2019 to 30 June 2021

  • Underfloor and ceiling insulation is compulsory for all Mayfair and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement as well as an Insulation Statement, and an Insurance Statement should be included with any renewal, new or modified tenancy agreement.
  • Property managers and landlords must keep records that prove conformance with the Healthy Homes Standard that apply or will be applicable during the tenure of an apartment rental.

From 1 July 2021

  • Private landlords and property managers have to make sure their rental properties conform to the Healthy Homes Standards within 90 days of any new, renewed or varied Tenancy.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarder home tenancies) must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes that are rented out from Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must be in compliance with the Healthy Homes Standards regardless of when the tenancy first began.

From July 1st 2024

  • All rentals houses must be in compliance with the Healthy Homes Standard regardless of when the tenancy began.

For example, if an open fireplace isn’t in use it can create draughts. This should be shut off. Heating Mayfair

Mayfair rental properties should have a permanent source of heat which can warm the largest or main living area to at minimum 18degC even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental well-being.

The heating source needs to remain fixed (i.e. not portable) with at least 1.5 Kilowatts in heating capacity, and it must have the minimum required heating capacity in the living area. The Heating Assessment Tool can be used to check if the existing installed heater(s) are adequate or whether you will need to top up by adding a second heater. Unflued combustion and open fire heaters such as portable LPG bottle heaters aren’t considered acceptable heating options in those following the Healthy Homes Standard.

If the heating you offer is electric heating or heat source, it requirements to have a thermostat. This will help make the heating more uniform and efficient. For most properties, larger fixed heating systems such as heat pumps, wood burners pellet burners, flued gas heaters are necessary. However, in certain instances like small apartment buildings the smaller fixed electric heater may be sufficient.

If the main living room already has a permanent heating source, such as an air conditioner, it may require an upgrade to ensure it meets the requirements. Certain types of heaters cannot be used to achieve the quality since they’re either costly, not cost-effective to run, and/or unsafe to run.

Ventilation Mayfair

Each liveable space in the rental property should contain at minimum one open doors or windows to provide natural airflow. In addition, humid spaces like kitchens and bathrooms must have a suitable externally vented extractor to take moisture away.

Insulation Mayfair

The insulation of the ceiling and underfloor has been compulsory in all rental homes since 1 July 2019. All landlords and property managers should ensure the insulation meets this new standard.
