Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed on a Mayfair rental property, all Healthy Homes compliance items have to be done inside of 90 days.

As of 1st July 2021, when a new or renewed Tenancy is signed for a Mayfair rental property, all Healthy Homes compliance work must be finished inside of 90 days.

Failure to comply with all of the Healthy Homes Standards by the end of the anticipated timeframe could result in an amount of $7200. In addition, if the present Healthy Homes Statement of Compliance is not included within a new, renewed or revised tenancy agreement, there could be an additional fine or infringement fee.

Anyone can request details regarding the Healthy Homes Standard and how they relate to the property they are living in. If the landlord or property manager fails to provide the necessary information within 21 days from receiving the request, they may receive an infringement notification and be fined upto $750.

Additionally, there is also a penalty approximately $900 for property owners or property managers who provide a false or incorrect Healthy Homes Compliance Statement or any other information. The person responsible to pay this fine is the one who is identified on the tenancy contract as the person renting the property which could be the landlord’s name or the property management company.

The information contained in the Compliance Statement requirements to be current before the tenancy agreement can be executed, and it must be updated during the entire tenancy, as relevant work gets completed.

It is also important to remember that a landlord who manage multiple rental properties could face greater penalties for non-compliance. The harshest penalties are reserved for the most serious breaches, and landlords with six or more properties can be fined as high as $50,000, and as much as $100,000 for hearing claims.

In the end, a failure to meet the Healthy Homes requirements can hit your bank account hard, and result in significant fines and still being required to adhere to the regulations. Do not risk your rental property Call us today and ask us to conduct an home assessment done for your rental property.

Healthy homes matter

What are the reasons why Healthy Homes Compliance so important?

One in three households rent in New Zealand and Mayfair, and research has shown that these rental homes are most likely to be older, colder, are not as efficient heating, and generally have lower quality than the houses of owners.

Cold, damp and mouldy homes are linked to negative health outcomes, especially for diseases like colds and flu, asthma and cardiovascular issues. Additionally, those who have reported at least four key issues with their housing often have poor life satisfaction and lower mental wellbeing.

The improvement in the standard of Mayfair rental property can allow tenants to experience better physical and mental health and minimise the disruption to work, learning and daily life due to illnesses. Your investment will be secured from mildew, mould and damp-related damage, which results in less costs of maintenance in the long run.

Unreasonable Gaps & Holes

Draught Stopping Mayfair

Draughts may lead to low temperatures inside homes. A draughty home costs more to heat, meaning wasting energy and increased bills.

If a draught can be noticed from gaps that are not adequate or holes or holes, it requirements to be closed.

What are unjustifiable gaps or holes?

If you are able to feel external air flowing in or the sound of a clear draught emanating from a hole or gap and you can feel it, it is most likely a gap or hole that needs sealing in any way. Cracks and gaps that are large should be permanently stopped. Cracks that are greater than 3mm and let air into or out within the home need to be sealed. For example, if an open fireplace isn’t being used, it can cause draughts and should be blocked off. Property managers and landlords are accountable for making sure that draughts from the fireplace are removed as much as possible.

You don’t require to block off holes or gaps in the construction. For example, tiny gaps around windows and doors may be required to allow for the movement of the building when the house gets warmer and cooler, so that they are able to be closed and opened rather than sticking. We will test every window and door during our Healthy Homes assessment of your rental property.

Heating Mayfair

Mayfair rental properties need to have a stable heating source that can heat the main or largest living room to at least 18degC even on the coldest days of the year. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical well-being and mental outlook.

The source of heat requirements that it be permanently fixed (i.e. not portable) with at minimum 1.5 horsepower in capacity, and must meet the minimum heating capacity needed for the main living room. A Heating Assessment Tool may be used to check if the current installed heater(s) are sufficient or if you’ll need to "top-up" by adding a second heater. Open fires as well as unflued combustion heaters such as portable LPG bottle heaters aren’t considered to be acceptable heating options for Healthy Homes Standard. Healthy Homes Standard.

If the heating you provide is an electric heater (or heat pump), it should include a thermostat. This will help make your heating more consistent and effective. For most houses, larger fixed heating devices such as wood burners, heat pumps pellet burners, flued gas heaters are required. However, in certain instances like apartments with small spaces the smaller fixed electric heater may suffice.

If the main living room already has a central heating source, such as an air conditioner, it could require some additional energy to meet the standards. Certain kinds of heaters cannot be used to comply with the standard because they’re inefficient, unaffordable to operate or are unsafe to operate.

Ventilation Mayfair

Every living space of a rental home must have at least one openable door or window to offer natural ventilation. Furthermore, moist areas such as kitchens and bathrooms must have a suitable venting fan outside to get rid of moisture.

The ventilation quality is all about acknowledging the fact that dried air can be less difficult to heat, and that a well ventilated rental property will be less prone to developing damp and mould.

Living rooms, bedrooms, dining rooms, and kitchens are all considered living spaces. Spaces that connect, such as the hallway aren’t considered liveable and don’t need an opening window or door.

Each window, door or Skylight requirements to be able of opening to the outside and remain closed, allowing the circulation of fresh air and air flow.

The bathrooms in all kitchens and any other room in your house that houses shower, bath or cooktop, or any other humidity-generating items will require suitable extractor fans that are vented towards the outside. The Healthy Homes Assessment service will make sure there is sufficient ventilation throughout the living spaces and will also check for the proper extractor fans for areas that are high in moisture.

Insulation Mayfair

The insulation of the ceiling and underfloor has been compulsory for all rent homes as of July 1st, 2019. All landlords and property managers are required to ensure that the insulation is in line with this new standard. In some cases, old ceiling insulation as well as insulation within the subfloor space may need to be added or replaced.

A properly insulated home can reduce condensation, and decrease the risk of mould and dampness and it will make more easy to allow the household to hold warmth.

Insulation needs to be in compliance with the R-values required for your area

The "R" is a symbol for thermal resistance and is a gauge of how well insulation can withstand heat flow. The more high the R-value, better the insulation.

  • Zone 1 Zone 1 Auckland & Northland - ceiling R 2.9 and underfloor R 1.3
  • Zone 2 – The rest of the North Island except Taupo and the Central Plateau – ceiling R 2.9, underfloor R 1.3
  • Zone 3 - North Island Taupo, Central Plateau and the entire South Island – ceiling R 3.3, underfloor R 1.3

Mayfair Moisture Ingress & Drainage

Protecting your rental property from the effects of moisture isn’t just a matter of what’s inside the building It’s about having to make sure there is somewhere to allow surface, rain or ground water and stop it from coming inside. When it is about damp and water, it is typically not apparent that it can become a big problem and cause damages to your investment and affecting the tenant’s well-being.

Rental properties should be equipped with effective drainage for the removal of floodwaters, surface water and ground water, including the proper outfall or runoff. Making sure that water has a location to go, and that it isn’t allowed to remain beneath buildings is an essential part of maintaining your property’s dry.

In addition to a drainage system to avoid the ingress of moisture, if your rental is enclosed between floorboards and the ground, a ground moisture barrier should be put in place if it’s reasonably practicable to do so.

An underground moisture barrier generally made of polythene and is laid on top of the ground, in order to block any moisture present in the ground from entering the home. It also helps to prevent moisture damage to the underfloor insulation.
