Fines for Failing to Comply

From the 1st of July in 2021, when a brand new or renewed tenancy is signed for a Putorino rental property, all Healthy Homes compliance tasks need to be finished within 90 days.

Since the 1st July of 2021, if a new or renewed Tenancy is signed for the Putorino rental property, all Healthy Homes compliance work must be completed by the end of 90 days.

Inability to adhere to one of the Healthy Homes Standards inside of the anticipated timeframe could result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance isn’t included in a new, renewed or revised tenancy agreement, there may be additional penalties or an infringement fee.

Additionally, there is also a penalty up to $900 for landlords or property managers who offer a false or inaccurate Healthy Homes Statement of Compliance or any other information. The person who is responsible for this fine is whoever is named on the tenancy agreement as the one who is letting the property out which could be the name of the landlord or the company that manages the property.

All information in the Statement of Compliance requirements to be accurate when the tenancy contract is signed. It is updated through the tenancy period as related work is completed.

It’s also important to be aware that a landlord with multiple rental properties may receive greater penalties for non-compliance. The highest penalties are given for serious breaches, and landlords with more than six properties could be fined as high as $50,000, or as high as $100,000 for hearing claims.

Putorino Healthy Homes Compliance Timeframes

Tenancies established in the period between July 1st 2019 and 30 , June 20,21

  • The insulation of the ceiling and underfloor is a requirement in all Putorino and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Declaration of Intent along with an Insulation Declaration and an Insurance Statement should be included in any new, renewed or amended tenancy agreement.
  • Landlords and property managers must keep records that demonstrate the compliance with the Healthy Homes Standards that apply or will be applicable during the tenure of your rental home.

Beginning 1 July 2021

  • Private landlords and property managers should ensure their rental properties comply with the Healthy Homes Standard within 90 days of any renewal, new or a change in tenant.
  • All boarder homes (except Kainga Ora and registered Community Housing Provider boarding house tenancies) must comply with the Healthy Homes Standard regardless of the date when the tenancy started.

From 1 July 2023

  • All houses let to Kainga Ora (formerly Housing New Zealand) and Community Housing Providers that are registered are required to comply with the Healthy Homes Standards regardless of when the tenancy first began.

Starting 1 July 2024

  • All rentals houses must comply with the Healthy Homes Standards regardless of the date when the tenancy started.

Heating Putorino

Rental properties in Putorino require a reliable source of heating that can heat the main or largest living space to a minimum of 18degC, even during the coldest winter days. This is the minimum temperature indoors that is recommended by the World Health Organisation for people’s physical health and mental wellbeing.

The heating source requirements to be fixed (i.e. not portable) with at minimum 1.5 Kilowatts in heating capacity, and meet the minimum heating capacity needed for the main living space. All landlords and property managers have to ensure the insulation meets standards that are in line with the latest quality.
