Fines for Failing to Comply
As of 1st July 2021, when a new or renewed tenancy is signed on a Putorino rental property, all Healthy Homes compliance tasks have to be taken care of by the end of 90 days.
Beginning on July 1st, 2021, when a new, renewed or varied Tenancy is signed for the Putorino rental property, all Healthy Homes compliance work must be taken care of by the end of 90 days.
Failure to meet one of the Healthy Homes Standards within the anticipated timeframe could result in an amount of $7200. Additionally, if a present Healthy Homes Statement of Compliance isn’t incorporated in an updated, renewed, or revised tenancy contract, it could result in additional penalties or an infringement fee.
Any tenant may request information about the Healthy Homes Standard and how they relate to the property they reside in. If the landlord or property manager fails to provide the required information within 21 days of getting the notice, the tenant will receive an infringement notice and be fined as high as $750.
In addition, there is an additional fine of as much as $900 for property owners or property managers who have provided a false or false Healthy Homes Statement of Compliance or other information. The person who is liable for this fine is the one who is named on the lease agreement as the one who is who is letting the property which could be the name of the landlord, or the company that manages the property.
The information contained in the Statement of Compliance needs to be up-to-date when the tenancy contract is executed, and it must be updated throughout the duration of the tenancy when any associated work has been completed.
It’s also important to remember that a landlord with multiple rental properties may face additional fines for non-compliance. The harshest penalties are reserved for severe breaches. Landlords with at least six rental properties could be penalised up to $50,000, and as much as $100,000 in the case of hearing claims.
