Fines for Failing to Comply

Beginning on July 1st, 2021, when a brand new, renewed or varied contract is signed on a Taradale rental property, all Healthy Homes compliance items have to be taken care of inside of 90 days.

As of 1st July 2021, if a new, renewed or varied tenancy is signed on the Taradale rental property, all Healthy Homes compliance work must be taken care of inside of 90 days.

Failure to meet one of the Healthy Homes Standards by the end of the expected timeframe can result in the possibility of a fine up to $7200. Additionally, if the most existing Healthy Homes Statement of Compliance is not included in a new, renewed or revised tenancy agreement, there could be additional penalties or an infringement fee.

Anyone can request details about the Healthy Homes Standard and how they relate to the building they are living in. If the the property manager doesn’t supply the required information within 21 days from having received the inquiry, they will receive an infringement letter and be fined as high as $750.

In addition, there is an additional fine of up to $900 for landlords or property managers who have provided a false or inaccurate Healthy Homes Compliance Statement or information. The person liable for this fine is whoever is identified on the tenancy agreement as being the person letting the property out and it could be the name of the landlord, or the property management company.

The information contained in the Compliance Statement requirements to be current when the tenancy agreement is signed, and ideally it is updated through the tenancy period as associated work has been completed.

It’s also important to note that landlords who own multiple rental properties may face more severe penalties for not complying. The harshest penalties are given only for serious breaches. Landlords with six or more properties could be fined up to $50,000, and even as high as $100,000 in the case of hearing claims.

Taradale Healthy Homes Compliance Timeframes

Tenancies commenced between 1 July 2019 to the 30th June in 2021

  • Underfloor and ceiling insulation is a requirement throughout Taradale and New Zealand rental houses where it is reasonably practicable to install.
  • A Healthy Homes Intent to Comply Statement along with an Insulation Declaration and an Insurance Statement must be included with any renewed, new or varied tenancy agreement.
  • Property managers and landlords are required to keep records that demonstrate the compliance with each Healthy Homes Standard that apply or will be applicable throughout the tenancy period of your rental home.

From 1 July 2021

  • Property managers and private landlords must ensure that their rental properties are in compliance with the Healthy Homes Standard within 90 days of any renewal, new or a change in Tenancy.
  • All boarder homes (except Kainga Ora and Community Housing Providers with registered boarding household tenancies) must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2023

  • All homes rented through Kainga Ora (formerly Housing New Zealand) and registered Community Housing Providers must meet the Healthy Homes Standards regardless of the date when the tenancy started.

Beginning 1 July 2024

  • All rentals houses are required to comply with Healthy Homes Standard regardless of when the tenancy first began.
Unreasonable Gaps & Holes

Draught Stopping Taradale

Draughts can lead to dropping temperatures within homes. A humid home will cost more to heat, meaning wasting energy and resulting in higher bills.

If a draft can be perceived as a result of gaps or holes that it needs to be closed.

What are the most unreasonable gaps or holes?

If you can feel external air entering or the sound of a clear draught emanating out of a hole or gap, then it’s probably a gap or crack that requirements sealing in some way. Large gaps and cracks should be fixed permanently. The gaps that exceed 3mm that allow air in or out of the home need sealing. In the case of an open fireplace isn’t being used, it can create draughts. This must be sealed from. Landlords and property managers are responsible for ensuring such draughts are eliminated as much as possible.

You don’t need to cover up gaps or holes in the building. For example, tiny gaps around doors and windows could be necessary to allow for movement within the structure as the home is heated and cools so that they can still be closed and opened rather than being stuck. A good heating system is important for well-being houses

Heating Taradale

Rental properties in Taradale require a reliable heating source that can warm the main or largest living area to at minimum 18degC, even during the coldest days of the year. This is the minimum indoor temperature suggested by the World Health Organisation for people’s physical health and mental wellbeing.

The source of heat requirements that it be permanently fixed (i.e. not portable) that is, at minimum 1.5 kW in heating capacity, and must meet the minimum requirement for heat capacity in the living area. If the heating you offer is an electric heater (or heat pump), it should be equipped with a thermostat. This will make your heating more consistent and efficient. For most properties, larger fixed heating systems such as wood burners, heat pumps, pellet burners or flued gas heaters are required. However, in some cases like apartments with small spaces small apartments, a smaller electric fixed heater may be sufficient.

If your main living space already has a fixed heating source, like a heat pump, then it could need an update in order to comply with the standards. Certain types of heaters cannot be utilised to meet the quality because they’re expensive, inefficient and/or unsafe to run.

Ventilation Taradale

Each liveable space in a rental property must include at least one open door or window to offer natural airflow. Furthermore, moist areas like kitchens and bathrooms need to have an venting fan outside to remove moisture.

A ventilation quality is all about recognising it is that dry air is more easy to heat and that a well ventilated rental property is less likely to be a victim of mould and damp.

Bedrooms, living rooms kitchens, and dining rooms are considered to be liveable spaces. Connecting spaces like the hallway are not considered liveable and do not require an opening door or window.

Insulation Taradale

The insulation of the ceiling and underfloor has been compulsory to all rental homes as of July 1st, 2019. All landlords and property managers must ensure that the insulation is in line with this new quality. In some cases, an existing insulation on the ceiling or in the subfloor space may need to be added or replaced.

A house that is well-insulated can reduce condensation, and decrease the risk of mould and damp, and will also make much easier to allow the house to hold the heat.

The "R" refers to thermal resistance, and it is a measurement of how well insulation resists heat flow. The higher the R-value, the higher the quality of insulation.
